Employment problems

Fri, June 19, 2009 9:25 AM

Hello out there!

I have had Crohn's for at least 30 years, with %70 of intes track taken out in 1970 and I do pretty well under the circumstances.   I have a question:

In the middle of cleaning and packing up my classroom for the summer, I took ill, ( a flare up, and joint problems).  I was not able, and just now beginning to feel better, to finish my classroom.  The district is holding my final pay until I can get movers in my room to finish cleaning/packing.

I'm having some big problems with the new principal, like assigning me to second grade, which I've been teaching for the last five years, and moving me to 6th grade. WoW!

Legally, can they hold my check?

Thanks!  Any ideas are greatly appriciated.

are you a teacher?   if so, do you have a union.  take the problem to your union rep.  it is illegal to hold an employees paycheck for ANY reason.

Agreed, in the state of CA your employer has 72 hours from your last hour worked to deliver all pay due in full. If they haven't, they will not only need to pay you retribution for every day that your pay is withheld, they'll have to pay fines as a business. You could contact your Labor Board, as suggested, or any employment attorney. Good luck.

Hi,

You didn't mention where you live? Your employer CANNOT hold your pay for any reasons. I know in Calif. that is the case. You need to contact the Labor Board and file a complaint. I did it in calif and received my regular daily pay for everyday they held my check!! Good Luck,  Rich

If you are a member of a union, contact your union rep. and they can assist you.

Sounds like you need to contact your state teachers association or the NEA. Don't think they can do that.
