Intermittent medical leave

Has anyone here received intermittent medical leave under the FMLA for Crohn's disease? Occasional flare ups cause me to miss work every now and then, and our sick policy disciplines employees if they miss more than two days in a six month period (we get 10 sick days per year, but aren't permitted to use them). I have co-workers that have intermittent leave for migraines, rheumatoid arthritis, and diabetes, among other things. I can't understand why Crohn's disease is not viewed as an illness that can cause legitimate recurring problems that are serious enough to excuse a periodic absence. BTW, I'm employed as an RN in an 810 bed teaching hospital.

I also get intermittent leave under FMLA for UC. You should be able to get it approved.

I handle the HR for my employer and am not an expert but fairly familiar with FMLA and ADAAA (they added two "A's" last year). Having UC myself I'm probably going to be a little more understanding and, as an employer I would say we are much more understanding than your employer, however, with the proper doctor's certification, I would probably approve intermittent leave in this case. Luckily, I've not been off enough to ask for it myself. Also, the new ADAAA seems to have significantly expanded the definition of a disability which may well include your situation. The bad news is you seem to be in the situation of having to force the issue with your employer to some extent. That's never comfortable but certainly an opportunity that you have. Hope you find a good solution.

If you get the time, I advise also looking into relevant Federal legislation regarding the Americans with Disabilities Act. There was some movement last year to extend better protection under the ADA to Crohn's sufferers.

You might also want to look into local labor laws as well. Providing sick time but not allowing you to use it smells funny to me.

Hi! I am also an RN in a large teaching hospital, and I have had int. FMLA for almost 2 years now. My GI doc had no problem signing the ppw for me, and I had no problem renewing it when the first year was up. I work noc shift, and would not be able to keep my job without it. This has been a huge stress reliever for me :-) Good luck to you!
