ADA/Employer

So my employer and myself just recently discovered that Crohn's is covered under the ADA. That is good for me right now since I do not qualify for FMLA yet. The issue I have now is that every time I am out sick now she wants a doctor note even for 1 day. Was wondering if any body is familiar with the ADA rules. It seems to me that that can not ask me to bring in a Dr note every time, if company policy says after 3 consecutive days you must have a Dr note unless they are going to make every employee bring one in after a day. So if any body knows about this or can steer me in the right direction. I looked at the ADA website but could not find anything.

I actually "retired" early from my job because my office was moved further away from the restroom and it was becoming increasingly difficult for me to attend long meetings throughout the day especially during times when I would anticipate some discomfort or urgency.  I was diagnosed with UC two years ago at age 52 (late).  I just had another colonoscopy that revealed the UC now encompasses my cecum and ascending colon in addition to the rectum.  I feel guilty that I'm not working but at the same time wonder where I could work  or who would accommodate me - UC is so unpredictable.  I feel safer at home...

Check with your HR weenies. See if they agree that you should have to furnish a doctor's note when you are out for a day, for if they require that of you, they MUST require it of everyone. That does not seem likely.

You need to be treated like everyone else, or they open themselves up to discrimination if you want to go there. HR will understand that; supervisors might not.

I had some issues with my employer and established my qualification as a person with a disability by following the ADA policies, which I found online. i had to have my doctor submit a letter including my diagnosis and what kinds of acomodations I might need. You should make sure you/he are very specific (e.g., work from home if needed; may need to go to the doctor, be late, have tests, etc). Then your office should come back with an offer of what they would need you to do. 
My office does not require a note every time, but anytime I'm going to be later than 8:30am, I have to email my manager and cc the hr director. I don't particularly like it either, but in the end, it's just a practice to make sure everyone is covered and no one is taking advantage.

If you don't want to give a letter everytime, I think you can make another offer by saying you're uncomfortable with that (most employers are going to try to steer clear of making someone with a disability uncomfortable for fear of discrimination) and offer what you will do instead (I would be willing to have my doctor send a list of dates at the end of each month, etc). 

On the other side, many doctors have a standard letter that only requires the doctor's signature and a date (usually filled in by the receptionist). It may be really simple and not worth fighting on.

I would like to start a section of the forum on employment related issues as I have a lot of discussion questions, comments, etc.

Thanks for bringing this up. No one at CCFA had any advice or answers when I spoke to the office!

I don't have the answer, but it may be worth checking the "Contact Us" tab above. 

They should be able to give you the guidelines.
