Got demoted because of being sick.

Sat, August 14, 2010 5:56 PM

I was in and out of the hospital May-June at least 5 times, I lost count. Battling my anemia and my UC. The company said they needed less supervisors and they told me I was a low performer.

When I got a meeting with the person who made the deicson, they told me I demoted for one reason. They said that it was the opinion of a supervisor, that I did not walk as fast as the as the others. That was the only reason they had. I told them I was on FMLA and I was sick, they said they couldn't reconsider but they were sorry to hear that.

I was crushed, I spent most of my weekends in the hospital so I could return to work because I know there are less supervisors and attendance is important. I was really good at my job.

At that moment I felt like am never going to get ahead in life, because am always going to be sick at some point. And nobody wants someone like that.

Can you get covered by the fmla if you are going to graduate college soon? And if so, how?

I've been struggling a lot with my job. My boss has agreed to certain solutions to my uneven schedule, then gone back on them later. Calling the ADA hotline left me feeling pretty hopeless to be honest, but the bottom line is sticking up for yourself. I plan to do so in the very near future, but at this point I'm job hunting for a lot of reasons.

My schedule has been changed multiple times and my hours have been drastically reduced. My boss has lectured me over and over on how I'm unreliable, letting my co-workers down, and how frustrating it is for her.

I always think, "Crohn's is unpredictable, Crohn's is holding me down, Crohn's is frustrating!"

I have struggled with "performing" at work for years. I'm a hard working sharp individual. But my disease gets in the way. My wife left me after I lost my last job. It's hard. I really do feel your pain. It beats you up emotionally. Crohns is a downward spiral. My ex career was managing in the building construction industry. I applied for Social Security Disability and was just denied. I cant work. I am getting a lawyer to appeal. Quite honestly, I don't want to give up working. My life goals are much bigger than what I will get from SSDI. But I need to focus on getting better. The disease is bad enough... let alone the lack of empathy people have for me. I hope to study at my own pace so I can change careers/ work out of the house. It's something to consider. I'm curious if others have done what I plan on doing. Best of luck. Stay strong.

This has occurred to me a few times but I was let go. Late clocking in for work because I sat in the car because I felt if I moved, I would have an accident. After the pains finally subsided enough to run into the restroom, I was told I was fired. I filed a grievance with the state to win my job back but was denied. Nice to see they care.

Lawsuits are gruelling and in the long run it will cost you your job.

You are better off telling your employer to shove it! Find another job first and then do it. It will make you feel so much better!

I went through the EXACT same thing in May of this year. I was out of work for 2 weeks due to being in and out of the hospital. I even attempted to return back to work and two days later I was rushed back to the hospital. Later that week the Human Resources Department called and informed me that they had to terminate me due to my work performance. So I know the feeling. I did file a claim with the EEOC against the company. Still waiting for the outcome.

Thanks Joe, that helps. I filled the paperwork against my company today, so we will see if anything happens.

You might want to look at this government web site.   ada.gov   This is all about the 'Americans with Disabilities Act'. You can also find out information at 1-800-514-0301.  Just see what your options are and then decide what you want to do. There is a lot of ignorance out there in the business world. You have to educate people. You have to stand up for yourself. Try and keep as positive a spin on your IBD as you can. You have to have hope. You have to.

Sorry to hear about your illness and the problems you are encountering. The only suggestion I can offer, especially since you are covered by FMLA is to find yourself a lawyer that specializes in disability. Also consider whether or not you want to resume working for the same company. Good luck and keep us posted. We care on this board. Marilyn
